Minelab Father’s Day Contest

Schedule

1. Eligibility
   1. The Promotion is open to legal residents of the Commonwealth of Australia aged 18 and older.
   2. Participation requires: (a) a computer, phone, tablet or other electronic device with access the internet; and (b) to have found an item (Find) using a Minelab metal detector owned by the participant.
   3. The following persons are not eligible to participate in the Promotion:
      1. employees, officers, and directors, of the Sponsor and it's related entities (as defined by the Corporations Act 2001);
      2. employees, officers, and directors of any advertising, fulfilment or marketing agencies engaged by the Sponsor in relation to the Promotion and any of its related entities (as defined by the Corporations Act 2001); and
      3. the immediate families (parent, child, sibling & spouse, and their respective spouses, regardless of where they reside) and persons living in the same households (whether related or not) of any person(s) listed in clauses 1)(c)(i)-(ii).
2. How to Participate
   1. Eligible participants must access the Promotion entry page located on the Minelab website: https://www.minelab.com/fathers-day-competition and complete and submit the entry form by providing all requested information of the participant including:
      1. full name;
      2. email address;
      3. residential address;
      4. birth year;
      5. phone number (optional and only to be used to contact winners);
      6. one or more photo(s) of the applicants family detecting outing with any type of Minelab metal detector;
      7. the type, serial number of the Minelab metal detector; and
      8. 100 words or less on what metal detecting with Minelab means to your Family
          
3. Entry Requirements
   1. Entries must not contain (as determined by the Sponsor in their absolute discretion) any content that:
      1. contains nudity, is sexually explicit, profane or pornographic;
      2. is obscene or offensive;
      3. is violent;
      4. is derogatory of any ethnic, racial, gender, religious, professional or age group;
      5. promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of them);
      6. promotes any activities that may appear unsafe or dangerous;
      7. promotes any particular political agenda or message;
      8. is or appears to be a duplicate of any other submitted contest entry;
      9. defames, misrepresents, or contains disparaging remarks about other people or companies;
      10. contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission;
      11. contains any personal information or identification, such as license plate numbers, or street addresses;
      12. contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission;
      13. contains any individual other than you or any materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities or other public or private figures, living or dead, without providing legal releases for such use in a form satisfactory to the Sponsor;
      14. contains look-alikes of celebrities or other public or private figures, living or dead;
      15. communicates messages or images inconsistent with the positive images and goodwill to which Sponsor wishes to associate; or
      16. violates any law.
   2. By submitting an entry to the Promotion (Entry), you represent and warrant that:
      1. your Entry is original to you, has not been previously published, and has not won previous awards;
      2. neither the Entry nor its contents infringes upon or violates the rights of any third party, including any copyrights, trademarks, rights of privacy, publicity or other intellectual property; and
      3.  that you consent to the submission and use of the Entry in the Promotion and its use by the Sponsor.
   3. Entries that do not contain all required entry information or are considered inappropriate for any reason are not eligible and will not be considered.
   4. The Sponsor reserves the right not to award all prizes if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries.
   5. Prize awards are subject to verification of eligibility and compliance with these Terms and Conditions.
   6. If it is discovered during prize verification you have entered, attempted to enter, or used multiple accounts to enter more than the stated limit (if any), you may be disqualified in the Sponsors absolute discretion.
   7. All Entries become the property of the Sponsor and will not be acknowledged or returned.
       
4. Timing
   1. The Promotion will run for the Promotion Period.
   2. Any entries into the Promotion received after the end of the Promotion Period will not be accepted.
       
5. How to Win
   1. Once the Promotion Period has ended all valid Entries will be assessed by the Sponsor.
   2. All Entries names will be put into an online randomiser and Ten (10) winners will be randomly drawn using an online name picker https://wheelofnames.com/ :
       
6. Winner Notification
   1. Potential winners will receive prize notification via phone or email within one week of the winner selection or as soon as is reasonably practicable.
   2. To be considered an eligible winner the individual may be required to produce additional verification in relation to the Entry.
   3. Potential winners will forfeit their prize if:
      1. the potential winner(s) cannot be contacted within a reasonable period;
      2. the potential winner(s) are ineligible for any reason;
      3. any notification is returned undeliverable; or
      4. the potential winner(s) otherwise fail(s) to comply with these Terms and Conditions.
   4.  If a potential winner forfeits their prize, an alternate winner will be selected from among all remaining eligible entries using the criteria stated in clause 5).
       
7. Prizes
   1. The total prize pool consists of the following:
   2. Major Prize (10 prize) (Total Value AUD $51.50)
      1. 1x Minelab trucker cap;
      2. 1x Minelab Bucket hat;
      3. 1x Minelab cooler bag;
      4. 1x Minelab bottle;
      5. 1x Minelab bottle opener keyring;
      6. 2x Minelab stickers (bumper and round);
      7. 2x Minelab cutlery sets;
      8. 1x Minelab hi bounce ball; and
      9. 1x Minelab stubby cooler.
          
8. Prize Restrictions
   1. Prizes will be awarded only upon winner redemption, confirmation, verification, and final approval by Sponsor.
   2. The Sponsor is not responsible for late, lost, stolen, damaged, delayed, or undelivered prizes.
   3. Prizes are awarded “as is” with no guarantee.
   4. Any and all warranties, whether express or implied, including the warranties of merchantability and fitness for a particular purpose, are hereby disclaimed by the Sponsor to the fullest amount permissible by law.
   5. Any costs and expenses associated with prize acceptance and use not specified herein as being provided, are the winners’ sole responsibility.
       
9. Prize Conditions
   1. The Sponsor will only award the prize upon potential winners' eligibility verification and final approval by the Sponsor.
   2. The Sponsor reserves the right to perform a detailed background check on potential winners and submission of an Entry authorises the Sponsor to perform that detailed background check.
   3. No prize substitution, cash equivalent of prizes, transfer or assignment of prizes is permitted, except by the Sponsor, which reserves the right to substitute a prize with one of comparable or greater value, in its sole discretion.
       
10. Ownership of Entries
    1. By submitting an entry to the Promotion, you agree to be bound by these Terms and Conditions and grant the Sponsor a non-exclusive, royalty-free, worldwide license to use, modify, delete from, add to, publicly perform, publicly display, reproduce and translate your Entry in perpetuity, including without limitation the right to distribute all or part of your Entry in any media formats through any media channels.
    2. By submitting an Entry, you consent to use by the Sponsor (including its related entities, and licensees) of your name, likeness, and image in any media or format now known or hereafter invented, in any and all locations, without any payment to or further approval from you. You agree that this consent is perpetual and cannot be revoked.
    3. For use beyond the consent granted, you agree that Sponsor’s use of your personal data will be governed by the privacy policy posted on the Sponsor website.
        
11. Release and Indemnity
    1. By participating in the Promotion you release, indemnify and agree to continue to indemnify, discharge, and hold harmless the Sponsor, (including its related entities and all of their respective employees, directs and agents) from all claims, demands, damages, actions, costs and expenses (including legal expenses), whether direct or indirect, arising out of law or equity which may be due to or arising from participation in the Promotion or any portion thereof, including the acceptance, use/misuse, or possession of any prize that may be provided in connection with the Promotion.
        
12. Miscellaneous
    1. Capitalised terms used in these Terms and Conditions have the meaning given in the schedule unless stated otherwise.
    2. Participation in the Promotion constitutes acceptance of these Terms and Conditions.
    3. By participating, you agree to the decisions of the Sponsor or its nominated agent, which are final and binding in all respects and may be made in the Sponsor’s absolute discretion.
    4. The Sponsor is not responsible for late, lost, incomplete, corrupted, stolen, garbled, damaged, delayed, undelivered or misdirected entries, all of which may be considered void.
    5. Online entries will be considered to be entered by the authorised account holder of the e-mail address submitted at the time of entry and they must comply with these Terms and Conditions.
    6. The authorised account holder is deemed the natural person assigned to an email address by an internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
    7. By entering the Promotion, you recognize and agree that the registration information provided by you will be made available to the Sponsor; use of such information will be governed by the Sponsor’s privacy policy found at https://www.minelab.com/privacy-legals .
    8. Upon entering the Promotion, you grant the Sponsor the right to print, publish, broadcast, and use world-wide in any media now known or later developed, your name, portrait, picture, voice, likeness, city and state of residence, and biographical information for any purpose, including but not limited to, advertisements, publicity, and other communications, worldwide, in perpetuity, without additional compensation, notification or permission, except where prohibited by law.
    1. The Sponsor is not responsible for printing or typographical errors in these Terms and Conditions or any Promotion-related materials.
    10. The Sponsor reserves the right, in its sole discretion to:
        1.  disqualify any individual that tampers with the entry process;
13. 10. 2. terminate, suspend, cancel or modify the Promotion and award the prizes for the Promotion from among all eligible, non-suspect entries received as of the date of termination using the procedure in these Terms and Conditions or in a random drawing if this Promotion is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, fraud, unauthorised intervention, technical failures or other causes that may corrupt or impair the integrity, fairness or proper play of the Promotion.
    11. The Sponsor is not responsible or liable for any events which may cause errors and/or the Promotion to be stopped, including but not limited to any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries, nor is it responsible for any problems or technical malfunction of any telephone, network or telephone lines, computer on-line systems, servers, or cable, satellite, or internet service providers, computer equipment, software or any other failure of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to yours or any other person's computer relating to or resulting from participation in this Promotion or downloading any materials in this Promotion.
    12. The Sponsor is not responsible for computer, mechanical, technical, electronic, network or other errors or problems, including any errors or problems that may occur in connection with the administration of the Promotion, the processing of Entries, or in any other Promotion-related materials.
    13. The Sponsor may stop you from participating in this Promotion if you violate these Terms and Conditions or act (in Sponsor’s sole discretion):
        1. in a manner Sponsor determines to be unfair;
14. 13. 2. with an intent to annoy, threaten or harass any other entrant or the Sponsor; or
        3. in any other disruptive manner.
    14. Should more prizes be awarded through a computer, hardware, or software malfunction, error, or failure, or for any other reason, in any prize category, than are stated for that category in these Terms and Conditions, the Sponsor reserves the right to award only the number of prizes stated. In no event will more prizes be awarded than those listed in clause 7).
    15. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms and Conditions, or the rights and obligations of entrant, winners, or Sponsor, in connection with this Promotion, shall be governed by, and construed in accordance with, the laws of the state of South Australia, without giving effect to any choice of law or conflict of law rules or provisions (whether of the state of South Australia or any other jurisdiction), which might otherwise cause the application of the laws of any jurisdiction other than the state of South Australia.
    16. Any action seeking legal or equitable relief arising out of or relating to the Promotion or these Terms and Conditions shall be brought only in the courts of the state of South Australia and by submitting an entry you hereby irrevocably consent to the jurisdiction of said courts and waive any claim of forum non-convenience or lack of personal jurisdiction you may have.
    17. All federal, state, local, and other taxes on prizes and any other costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of any applicable winner.
    18. Any act or attempt by an entrant to deliberately damage any website or undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made the Sponsor reserve the right to seek damages and other remedies (including legal fees on a full indemnity basis) from any such individual(s) to the fullest extent permitted by law.
    19. Every provision of these Terms and Conditions will be deemed severable as far as possible from the other provisions of these Terms and Conditions. If any provision is found to be void, illegal or unenforceable for any reason, it will be deemed to be severed and omitted from these Terms and Conditions. These Terms and Conditions, with the offending provision severed and omitted and with any consequential amendment if necessary, will otherwise remain in full force.
